Today, all state and local governments must seek permission from the federal government before arresting undocumented immigrants.

This could change in Texas starting in March, the month that SB4 is set to go into effect. In addition to allowing local police to arrest them, this law increases the penalties for crossing the border illegally.

It could result in a first-degree felony charge, which would automatically make them ineligible to stay in the country.

In addition, those found guilty of violating SB4 could face 180 days to five years in prison, depending on their criminal history.

What happens to repeat offenders?

Local law enforcement is required by law to comply with detainers issued by the U.S. Immigration and Customs Enforcement.

It also prohibits any Texas town, county or agency from limiting its cooperation with this department or a border agent.
