‘Goodbye’ to Trump’s rule against immigrants
«Today DHS closed the book on the public charge rule,» said Alejandro Mayorkas, DHS secretary in a statement.
«In the coming weeks, we will work with our federal partner agencies and community leaders to ensure that immigrants and their families have accurate information about our public charge policies,» the official added.
Trump’s controversial public charge rule
Today’s submission to the Federal Register ends the process to undo the changes made by the former Republican president and that sparked protests and several lawsuits, which ended up in the Supreme Court, where this week the Government asked to dismiss the appeal that Trump had presented. for the cancellation of this measure.
Public charge has not been applied since that same day, March 9, when a court order that nullified the 2019 public charge rule went into effect and DHS immediately stopped enforcing the rule. Today’s rule completes the last step in implementing that order, DHS noted in the release.
Other ‘strong’ measures also eliminated
With this step taken today, “the financial support affidavit that would have placed undue burdens on American families wishing to sponsor people who legally immigrate to the United States,” detailed Mayorkas, is also being demolished.
From October 2, 2020, the Immigration and Citizenship Service (USCIS) required an affidavit of financial support for most family-sponsored immigrants and some employment-based immigrants, Efe notes.
The person signing the affidavit agreed to financially support the named immigrant and became the sponsor once the potential immigrant became a lawful permanent resident. This measure was also scrapped today.

DHS is committed to ‘keep improving’
The Democrat had been one of the most critical voices against this rule that had frightened the undocumented population from seeking services for their American children, among others.
«Now we must ensure through legislation that a future president will never be able to try again to implement a policy of this type,» said Espaillat.
In that sense, Mayorkas warned that DHS is committed to implementing reforms that «improve» the immigration system and reduce «unnecessary barriers to legal immigration.»
The rule issued today will be officially published in the Federal Register on March 15.
