  • Capital murder: Luis Cervantes, 19, is accused of having killed Joseph Olguín, 24, who was shot, thrown into a garbage container and then set on fire
  • The boy faces the charge of capital murder, which in Texas is the only crime punishable by the death penalty.
  • For now, the motive for the crime is a mystery because Cervantes has not wanted to reveal why he killed the other boy.

Luis Joaquín Cervantes was arrested in Houston,

Texas, accused of the shooting murder of Joseph Luis Olguín, whom he also set on fire.

Cervantes, 19, was detained by the Houston Police Department (HPD, for its acronym in English) for being the alleged perpetrator of the murder of Joseph Luis Olguín, 24 years old at the time of death.

Luis Cervantes is accused of capital murder, which according to the Texas State Penal Code it is the only crime punishable by the death penalty.

However, Cervantes also faces the charge of authorized use of a vehicle, which in plain language means theft of a car and which he allegedly used during the time he evaded authorities.

The succession of events that led to the arrest of Cervantes began with a routine call to Houston Fire Department (HFD).

At 6:20 a.m. on Saturday, June 27, the HFD emergency number received a call from an alarmed neighbor to come forward to contain a fire in a dumpster.

The fire was reported in the back alley of a CVS pharmacy, at 4750 Irvington Boulevard, in the populous Northside Hispanic neighborhood in the north of the greater Houston area.

Firefighters arrived at the scene and saw that a metal garbage container was on fire and all the garbage was on fire and in danger of the fire spreading to neighboring homes and businesses.

However, when the firefighters finished containing the flames they noticed a very strange stench coming from the container.

As they approached the container, the HFD members discovered the burned body of a person and requested the presence of the HPD Homicide Division to investigate the case.

The firefighters assured that while they put out the fire they did not hear screams or complaints, so HPD agents determined that the person was already dead when he was set on fire.

In their investigation, the Homicide Division agents asked all businesses in the area, at the intersection where the fire occurred, to provide all the videos from the security cameras of their businesses in the hours before the fire was reported. .

The videos were the first piece to solve the puzzle of the strange crime That shocked the Hispanic neighborhood as authorities identified a stolen car that roamed the area of the fire.

During the autopsy performed on the body in the Harris County Institute of Forensic Sciences (IFS, for its acronym in English), the doctors confirmed to the Homicide Division officers that the victim was indeed already dead when they set fire to his body.

Until that moment the victim was unidentified. Doctors determined that the boy had died from several gunshot wounds that had been inflicted at close range.

Days later, a Hispanic family from Northside approached the IFS hoping to find out if one of their relatives, Joseph Luis Olguín, was in the local morgue, since the boy had disappeared.

Through forensic deoxyribonucleic acid (DNA) tests, the link between the dead boy and the family in need of answers was determined.

When the agents managed to identify the victim as Joseph Luis Olguín, they managed to have more pieces in the crime puzzle.

That Olguín was shot to death was the other piece of the puzzle, because the agents recovered ballistics evidence that allowed the connection of the deceased today with his alleged murderer.

According to the report of the Texas forensic doctors, Olguín had gunshot wounds to the head and left hand, which, perhaps, were made when he wanted to take cover from the shots.

The HPD Homicide Division agents then concentrated on investigating the dead boy’s personal, family and friendship environment.

Olguín, according to Texas investigators, was the father of a daughter, although he did not live with the girl’s mother, he had two brothers.

The boy was much loved by his family and friends who remember him for his jovial, generous nature, a lover of video games, the Mexican food that his uncles prepared and playing basketball in a Northside league. Nothing unusual in its environment.

Olguín was killed three days before his birthday on June 30, causing even more pain among his family and friends who were already preparing a party for him.

For more than a month, the agents interviewed dozens of people around Olguín, until someone gave them a clue.

A source told Texas Homicide Division agents that Olguín had had a grudge with someone named Luis.

That was the fourth piece of the puzzle, which led HPD agents to find the alleged killer. However, in the legal documents of the case, it is not specified what caused the quarrels between the dead boy and his alleged murderer.

Finally, on August 27, exactly two months after the body was discovered, agents from the HPD Homicide Division arrested Luis Joaquín Cervantes, accused of the shooting homicide of Joseph Luis Olguín.

Cervantes, according to the documents of the case, availed himself of his right not to declare anything until he had the presence of a lawyer.

The boy also asked Judge Ramona Franklin, of the 338th Criminal District Court in Harris County in Texas, that the state provide him with that public defender because he can’t afford one.

Luis Joaquín Cervantes faces the charges of capital homicide, unauthorized use of a vehicle and illegal possession of a firearm.

When he was arrested, he was carrying the pistol with which he allegedly killed Joseph Luis Olguín, for some reason that he has not wanted to reveal.

As of this writing, Judge Franklin has not determined when the case will be first heard.
