Donald Trump has gained support from some sectors after promising mass deportations if he’s elected to a second term as president.

But is mass deportation legal? Could Trump really follow through on these frightening campaign promises?

Immigration lawyer Jonathon Shaw speaks with MundoNow to clarify whether Trump’s claims are legal.

«Perhaps he can sign an executive order, but we are seeing that the resources that the federal government has for something this massive do not exist,» Shaw says.

Just as he did in 2016, the Republican politician’s presidential campaign is clearly based on border security.

In his first term he talked about building a wall in Mexico and now he promises to take an even harder line on immigration matters.

At nearly every rally Trump vows «we will carry out the largest domestic deportation operation in American history,» according to The New York Times.

«For me, those words he is using are to generate support to win the presidency or win the elections in November of this year,» Jonathon Shaw commented.

«They can sign a paper, but they don’t have the resources to do that,» he continues.

Immigrants are frightened at the prospect of another Trump presidency after actions taken by the Republican during his first administration, between January 2017 and January 2021.

Less than a month after entering the White House, simultaneous raids were carried out in at least 16 states and undocumented immigrants were ordered to be removed from religious temples, courtrooms and even hospitals.

In just one week, in February 2017, the Immigration and Customs Enforcement Service (ICE) deported 680 undocumented immigrants.

They lived in Illinois, Indiana, Wisconsin, Kentucky, Kansas, Missouri, Georgia, North Carolina, South Carolina, California, New York and Texas.

Trump’s immigration policy in his first administration did not stop with raids. He also blocked asylum requests from immigrants who did not apply from a safe third country.

He also suspended the Deferred Action for Childhood Arrivals (DACA) program.

Would it be possible to conduct mass deportations?

Currently, the immigration reality is very different from four years ago when, according to the Center for American Progress (CAP), it would cost approximately $10,070 per person to implement Trump’s agenda.

In other words, expelling the 11.1 million undocumented immigrants would cost the United States $112 billion.

That spending needs to be approved by Congress.

This is why Shaw maintains that the «federal government does not have the resources.»

Currently «there are three million deportation cases open in the immigration court system in the United States. The equivalent of 4,500 cases for each immigration judge.»

According to immigration lawyer Jonathon Shaw, that figure was published recently.

In his opinion, the U.S. government should be «giving immigrants the right to defend their case before an immigration court.»
