In recent days, renowned Costa Rican actress and singer Maribel Guardia was granted temporary custody of her grandson, José Julián Figueroa, by the Attorney General’s Office of Justice in Mexico City.
The decision came after Guardia filed a complaint against her daughter-in-law, Imelda Garza Tuñón, alleging domestic violence, neglect, and substance abuse.
According to journalist Carlos Jiménez, the Prosecutor’s Office concluded that the best option to ensure the child’s well-being was to place him with his paternal grandmother.
On his X account, Jiménez wrote: «They hand over @MaribelGuardia her grandson.»
The prosecution handed custody to Maribel Guardia after controversial process
«After hours of studies, interviews, expert assessments… and to ensure the child’s integrity, the @FiscaliaCDMX decided to hand over the son of Julián Figueroa to his paternal grandmother. At the same time, they are investigating Imelda Tuñón for a complaint against her.»
Televisa Espectáculos also corroborated the information, confirming that José Julián is now with Maribel Guardia and her husband Marco Chacón.
Maribel, who remained calm throughout, told authorities and her family that her greatest wish is for the child to soon return to his mother, always prioritizing his well-being.
On January 21, 2025, the child was taken into protective custody by Mexican authorities following an incident between Maribel and her daughter-in-law outside José Julián’s school.
In an Instagram post, the actress explained that she took this action «to defend the integrity» of the little one, though she avoided going into details.
«With pain, I announce that I have felt the moral duty to file a complaint against my grandson’s mother, with the sole aim of defending his integrity,» Guardia wrote.
The legal case Maribel Guardia is facing against her daughter-in-law has taken an unexpected turn in recent hours.
The Attorney General of Justice of Mexico City, Bertha María Alcalde Luján, announced the dismissal of Miguel Ángel Barrera Sánchez.
Prosecutor dismissed following a vicarious violence case
Barrera Sánchez was the head of the Prosecutor’s Office for the Investigation of Crimes Committed against Children and Adolescents.
«The reason for his dismissal is related to a case of vicarious violence that caused public outrage,» Alcalde Luján stated.
In a video released on social media, the prosecutor emphasized the importance of protecting the best interests of minors.
«Measures will be implemented to prevent precautionary measures without proper analysis of the context,» she asserted.
For her part, Addis Tuñón, Imelda’s aunt, expressed hope that this decision would benefit the widow of Julián Figueroa.
«I hope that by dismissing the corrupt official, a new review of cases can be made,» the journalist stated.

She added that Imelda’s defense could request the cancellation of the protective measures.
Tuñón stressed that she is not seeking to favor either party and highlighted the need to assess the suitability of both women.
«Both should undergo antidoping, toxicological, and psychological tests to ensure the child’s well-being,» she commented.
She suggested setting clear boundaries for Maribel Guardia as a grandmother and for Imelda as a mother.
So far, neither Maribel nor Imelda have commented on the dismissal of Barrera Sánchez.
The Costa Rican actress might provide an official statement in the coming hours on this sensitive matter.
Meanwhile, the controversy continues, and the case still generates divided opinions among the public.
