An ICE agent, identified as Scott Deiseroth, 42, was arrested in the Florida Keys for driving under the influence (DUI).

During his arrest, Deiseroth questioned a sheriff’s deputy’s U.S. citizenship and asked whether he was Haitian, as seen in recently released body camera footage.

The incident took place on August 13 around 3:30 p.m., when Colonel Chad Scibilia, second-in-command of the Monroe County Sheriff’s Office, responded to reports of a reckless Chevrolet truck on U.S. 1, near the Seven Mile Bridge.

Scibilia observed the vehicle swerving across lanes and onto the shoulder, according to El Nuevo Heraldo.

After radioing for assistance, officers stopped the vehicle on the Bahia Honda Bridge, about four miles south. Inside were Deiseroth and his two children, ages 7 and 9.

When Deputy Jonathan Lane approached, he asked where Deiseroth was headed.

Deiseroth replied he was returning to Miami from Islamorada — even though he was 70 miles south, driving in the wrong direction.

Attempt to Avoid Arrest

According to the footage, Scott Deiseroth reluctantly exited the vehicle and tried to convince the officers to let him go, claiming he was also a law enforcement officer.

Visibly intoxicated, he pleaded that he was going through a divorce and would lose his children if arrested.

“Lane, talk to me, man. We’re both in law enforcement. I’m going through a divorce. Don’t take my kids,” he said — alternating between pleading and anger.

After repeatedly failing the sobriety test, Deiseroth became more aggressive and racially profiled Deputy Markens Dorestant, who has a Caribbean accent.

“Are you Haitian?” Scott Deiseroth asked.

Dorestant replied, “That has nothing to do with race, sir.”

Lane intervened, saying his colleague’s background was irrelevant, but Deiseroth insisted, “Yes, it does.”

Scott Deiseroth’s Arrest and Its Consequences

When Lane determined Scott Deiseroth was unfit to drive, he proceeded to arrest him.

The ICE agent resisted, forcing officers to wrestle him into the back seat of a patrol car.

In the footage, Deiseroth can be heard yelling: “F*** you, Lane. You really screwed me.”

Lane responded: “I didn’t screw you. I’m not the one who drank and drove.”

Scott Deiseroth continued shouting and hitting his head inside the vehicle while officers contacted his estranged wife, who drove from Miami-Dade County to pick up the children.

According to the arrest report, he was transported to the Monroe County Jail on charges of DUI and child endangerment.

Context

The footage and police report have sparked concern over the behavior of a federal immigration enforcement officer who, during his own arrest, questioned another officer’s citizenship.

As of now, ICE has not issued any public statement regarding the ICE agent arrest case.
