On August 19, 2024, the Department of Homeland Security (DHS) implemented the «Keeping Families Together» program.
This initiative allows certain non-citizen spouses and stepchildren of U.S. citizens to apply for «parole in place.»
«Parole» is a discretionary measure by the DHS under section 212(d)(5)(A) of the Immigration and Nationality Act.
It allows certain non-citizens to be temporarily present in the United States for humanitarian reasons or significant public benefit.
Eligibility and Benefits of Parole in Place for Non-Citizens in the United States
This process is available only to those non-citizens who are already in the United States.
If granted «parole» and they meet the requirements, they may apply to adjust their status to legal permanent residents.
They do not need to leave the United States to be processed by a U.S. consulate.
It is estimated that 500,000 non-citizen spouses could be eligible for this program.
Additionally, about 50,000 non-citizen stepchildren could also benefit from this process.
