A three-year-old girl ended up with a traumatic brain injury after a car accident in Hialeah, Florida.

This incident occurred because the child was not properly secured in a carseat in the vehicle driven by 53-year-old Sonia Margarita Vivas Castillo.

The negligence came to light after Vivas was involved in a traffic accident at the intersection of East 4th Avenue and 33rd Street.

Unrestrained toddler was injured in car accident

The toddler was the only one injured in the accident. According to the arrest warrant she was riding in the back seat without a seatbelt.

It was 10:45 a.m. when officers from the Hialeah Police Department responded to a collision involving an injured minor.

Upon arriving at the scene, police found the little girl on the floor of the vehicle. She was moving at first, but lost consciousness.

Paramedics immediately transported the injured girl to the hospital. Her condition was critical.

The toddler’s diagnosis was grim — she suffered a brain hemorrhage and skull fracture requiring urgent intervention.

Sonia Margarita Vivas Castillo was arrested.

Witnesses and surveillance cameras indicated, according to the arrest report, that Viva Castillo had made a turn when she didn’t have right of way.

Officers reported that the impact of the collision caused her car to spin 180 degrees and the little girl was thrown to the floor.

Vivas Castillo’s legal situation worsened when the police discovered she didn’t have a driver’s license.

As a result, she was arrested and faces charges of driving without a license, causing serious injury and child negligence with substantial bodily harm.

Hialeah police did not detail the relationship between the victim and the driver.

However, they noted that Vivas Castillo remains in jail awaiting her court appearance, while the toddler remains in a critical condition in the hospital.
