Maribel Guardia, the renowned Costa Rican actress and singer, has been granted temporary custody of her grandson, José Julián Figueroa, by the General Prosecutor’s Office of Justice of Mexico City.

The decision came after Guardia filed a complaint against her daughter-in-law, Imelda Garza Tuñón, alleging domestic violence, neglect, and substance abuse.

According to journalist Carlos Jiménez, the Prosecutor’s Office concluded that the best option to ensure the child’s integrity was to place him with his paternal grandmother.

Meanwhile, the authorities continue to investigate the allegations against Imelda.

On his X account, Jiménez wrote:

«They hand over @MaribelGuardia’s grandson to her. After hours of studies, interviews, expert reports… and to guarantee the child’s integrity, the @FiscaliaCDMX decided to hand Julián Figueroa’s son over to his paternal grandmother. At the same time, they are investigating Imelda Tuñón following a complaint against her.»

Televisa Espectáculos also confirmed the information, stating that José Julián is now with Maribel Guardia and her husband Marco Chacón.

Maribel, who appeared calm throughout, expressed to the authorities and her family that her greatest wish is for the child to soon return to his mother, but for his well-being.

On January 21, 2025, the child was safeguarded by Mexican authorities after an incident between Maribel and her daughter-in-law outside José Julián’s school.

It should be noted that Maribel Guardia reported her daughter-in-law, Imelda Tuñón, to protect her grandson.

In an Instagram post, the actress stated she did it «to defend the integrity» of the little one, though without going into details.

«With pain, I communicate that I have found myself in the moral duty to file a complaint against the mother of my grandson, with the sole aim of defending his integrity,» wrote Guardia.

Imelda, for her part, accused Maribel of trying to «steal» the child, claiming that the actress went to José Julián’s school with police officers to take him away without her permission.

She stated she was not aware of the situation at that time.

Carlos Jiménez reported that Maribel’s complaint indicated that Imelda was engaged in parties and drug use, which resulted in the child being neglected.

However, Imelda denied these accusations, arguing that if her drug test had been positive, she would not be with her son.

Imelda Tuñón Responds to the Complaint and Reveals the Origin of the Conflict

Imelda also suggested that the conflict might have originated from the loss of Julián Figueroa, but denied being a bad mother and assured that she is fighting to regain her son, who is currently in the DIF.

Moreover, Imelda mentioned that the conflict with Maribel started after discovering infidelity by her husband Marco Chacón, finding evidence of this deceit on his computer.

The case continues to generate legal and emotional disputes, with mutual accusations between the parties involved.

Imelda plans to request a restraining order against Maribel Guardia due to safety concerns.

Regarding recent events, the communicator ‘Chamonic’ revealed that there was an altercation at the child’s school, where Imelda accused Maribel of trying to steal her son.

The situation quickly escalated with the presence of police and the child visibly distressed.
