The Department of Homeland Security (DHS) has confirmed President Joe Biden’s new immigration plan.

It will provide a pathway to residency and citizenship for undocumented spouses of U.S. citizens.

This plan is not yet in effect and is expected to be published in the Federal Register later this summer.

Now, the key details to the new immigration plan promoted by the president of the United States have been released.

The plan was revealed during a commemorative event for the 12th anniversary of the Deferred Action for Childhood Arrivals (DACA) program.

This new immigration decree aims to benefit about 500,000 undocumented spouses and about 50,000 children of U.S. citizens without documentation.

DHS has published a report detailing the requirements and beneficiaries of this plan.

According to the department, the new policy seeks to promote family unity in the immigration process and keep families together.

Current law allows undocumented individuals who entered the country legally and married U.S. citizens to adjust their status without leaving the country.

However, those who entered illegally must leave the United States to adjust their status.

Which is a complicated and dreaded process due to the Punishment Law, which imposes years of re-entry bans.

Biden’s new decree aims to change this situation by offering a process to consider applications for temporary stay permits.

This permit is directed to undocumented spouses who entered illegally and married U.S. citizens.

It would allow them to apply for legal permanent residency without leaving the country, reported by ‘BBC’.

Requirements include: having lived in the United States for at least 10 years before June 17, 2024.

Not posing a threat to public or national security, and being eligible for status adjustment.

Also, they must merit a favorable exercise of discretion by immigration officers.

DHS estimates that around 500,000 undocumented spouses could benefit from this plan.

However, undocumented individuals who pose a threat to public or national security will not be eligible.

They will be detained, deported, or referred to other federal agencies for further investigation or prosecution.

Criminal backgrounds that disqualify include criminal convictions that legally make the individual ineligible for status adjustment.

To consider the temporary stay permit, applicants must submit a form to USCIS with supporting documentation and pay a fee.

Additional information about eligibility and the application process will soon be published in the Federal Register, according to ‘Head Topics’.

The approval process will include a case-by-case review to determine whether the grant of the temporary stay permit is justified.

This will take into account the individual’s immigration history, criminal background, and security check outcomes.

DHS will also work with the State Department to facilitate non-immigrant visas.

This, based on employment for certain DACA beneficiaries and other non-citizens who graduated from U.S. universities.

This will give U.S. employers the certainty that they can quickly hire the talent they need.

In the past three years, the government has implemented several immigration measures to curb illegal entry and favor legal immigration.

These include family reunification permit processes for citizens of various countries and temporary stay permit processes for certain citizens with sponsors in the United States.

Biden’s executive order is likely to face legal challenges, as is often the case with presidential decrees.

However, Biden has had to use his presidential power to address the deficiencies of the immigration system.

This new plan represents a significant effort to alleviate the uncertainties and fears of immigrant families.

Offering a clearer and safer pathway to residency and citizenship for thousands of undocumented individuals in the United States.

Additionally, it reflects the Biden administration’s commitment to reforming and improving the immigration system.

Time will tell how this policy will unfold and what impact it will have on the vast and complex network in the country, noted by ‘BBC‘ and ‘Head Topics‘.
