Firefighter Carlos Encinas accused of raping a woman inside her house

He took advantage of a defenseless woman and ended up behind bars. Police arrested a firefighter identified as Carlos Encinas after he was accused of raping a girl after giving her a ride home because she was too drunk to drive.

Citing the authorities, Fox 10 reported that 25-year-old Carlos Encinas, a member of the Phoenix Fire Department in Arizona, was arrested. He allegedly took advantage of her impaired state and raped her at her house.

Carlos Encinas took advantage of an intoxicated woman

According to court documents cited by Fox 10, the victim, who was not identified, went out with her friends in downtown Phoenix on Thursday, March 17, and became too intoxicated to drive home safely. Carlos Encinas, who knew her but had never been romantically involved with her, offered to give her a ride home.

Once at the house, Carlos Encinas asked the victim if he could use her bathroom. She said he could and then passed out in her bed. The victim said that she then woke up and Carlos Encinas was sexually assaulting her, according court documents cited by Fox 10.

Carlos Encinas apologized to the victim

During the traumatic assault, «the victim tried to push (Encinas) and told him to stop,» according to part of the court documents. But the alleged assailant ignored all of the young woman’s protests and continued to rape her.

Two days after the incident, court documents cited by Fox 10 detailed, the victim and Carlos Encinas exchanged text messages in which he apologized for the rape and assured her that it would never happen again. According 12 News the aggressor texted the woman, «There is no excuse,» for what he had done.

Carlos Encinas allegedly told the police that the sexual encounter with the victim was consensual and stated that at that time «he did not hear the victim tell him to stop,» so continued to have sex with her. In the end, Carlos Encinas was arrested and charged with sexual assault.

12 News also quoted police as reporting that the victim believed she had gone to bed with all her clothes on and then woke up while the abuser was raping her. She repeatedly asked him to stop. She also revealed the apology text that the firefighter sent after committing the crime, blaming alcohol for his assault.

«There is no excuse»

“There is no excuse, and I’m not going to say or do anything that could change it. It’s not an excuse, but drinking didn’t help. I [sic] never been in this situation before, and it just sucks this happened to us,» Carlos Encinas reportedly said in a text message sent to the victim. This, according to police investigators quoted by 12 News.

After his arrest, the 12 News reported that Carlos Encinas told investigators he did not hear the victim tell him to stop and that he thought the sex was consensual. He also said that he believed the victim was flirting with him that night, but a witness denied this and claimed the victim was no friendlier than usual.

Was it his first offense?

Carlos Encinas was also accused of sexually assaulting another woman while intoxicated in 2020. He now faces a sexual assault charge and was being held on $10,000 bail, 12 News said on Saturday, March 26.

The Phoenix Fire Department released a brief statement after the arrest of the assailant: “The Phoenix Fire Department is aware of the police investigation of Carlos Encinas. At this time, Carlos is still employed as a firefighter with the Phoenix Fire Department.»
