President Joe Biden’s administration utilized waivers on Wednesday to bypass 26 federal laws, enabling the construction of a border wall in South Texas.

This action marks the first instance in which the Biden administration has exercised broad executive power, similar to actions taken during Donald Trump’s presidency.

The Department of Homeland Security published the announcement in the Federal Register, providing scant details about the work to be undertaken in Starr County, Texas.

This area, which faces a high level of illegal entry, encompasses 21 counties in the Rio Grande Valley sector.

According to government data, during the current fiscal year, around 245,000 illegal entries have been registered in this area.

Secretary of Homeland Security, Alejandro Mayorkas, emphasized the urgent need to construct physical barriers to halt illicit entries into the United States in these project areas.

Among the federal laws waived are the Clean Air Act, the Safe Drinking Water Act, and the Endangered Species Act.

These waivers will permit the use of funds allocated by Congress in 2019 for the construction of the border wall.

The rugged terrain of Starr County, situated between Zapata and McAllen, is home to approximately 65,000 residents and spans an area of about 1,200 square miles.

This land is part of the Lower Rio Grande Valley National Wildlife Refuge.

Although the announcement did not include any maps, US Customs and Border Protection (CBP) had previously introduced the project in June and received public feedback in August.

This new project could add up to 20 miles to the existing border barrier system in the region.
