Biden to restrict asylum standards for some migrants
The Biden administration proposed a new rule on Thursday.
This will allow authorities to restrict access to asylum for some migrants on the southern border, a source familiar with the regulation told EFE.
The rule will instruct immigration agents to apply new standards during interviews.
This is when they decide whether a migrant can go forward with their claim.
What does the new asylum rule say?
According to EFE, the authorities may prevent a person from requesting asylum if they consider that they pose a risk to national security or public safety.
Furthermore, this regulation, which seeks to expedite some deportations, will affect those who cross the border between Mexico and the United States irregularly.
After this initial interview, known as a “credible fear” interview, people seeking asylum can remain in the United States.
Then they must go before an immigration judge who will rule on the validity of their claim.
It is a long process
This process can take years and the goal of this new measure is to try to reduce the number of people seeking asylum.
People who are denied the ability to apply for asylum are immediately expelled to Mexico or enter formal deportation proceedings, depending on their nationality.
The rule, developed by the Department of Homeland Security, will not automatically go into effect.
After it is published there will be a public comment period.
Could this cause problems for Biden?
This new rule comes in the middle of an election year in which immigration is one of the central issues.
Republican presidential candidate Donald Trump has adopted anti-immigrant rhetoric and is accusing Biden of creating a “crisis” at the border.
However, this is not the first time the White House has announced changes to asylum regulations in an attempt to limit the number of people at the southern border.
Just a year ago, the Biden administration introduced a series of changes to who is eligible to apply for asylum at the border.
Is there an increase in the number of migrants crossing the border?
Although the number of border apprehensions has decreased significantly during the first months of this year, in 2023 the U.S. reported a record of more than 2.3 million migrant arrests.
This comes amid the global context of a historic increase in the number of displaced people on the continent.
The moderate wing of the Democratic party has put pressure on Biden to pull back on his promise to «restore» the asylum system, according to EFE.
In fact, the Biden administration has largely maintained restrictive policies inherited from Trump.
