An unexpected and devastating twist for Donald Trump.

Special counsel Jack Smith has appealed the decision of the federal judge who dismissed the criminal case against the former president.

Trump was investigated for illegally retaining classified documents after leaving office.

Smith’s appeal seeks to overturn the ruling made by district judge Aileen Cannon, who declared that Smith’s appointment violated the Constitution.

Cannon’s decision represents one of the latest legal victories for Trump, who has managed to evade several judicial cases against him, Reuters reported.

However, Smith’s office is not giving up and is determined to fight for justice.

The practice of appointing special counsels has been used for decades by administrations of both parties, and Cannon’s ruling breaks with precedent, according to the cited outlet.

These previous rulings from other federal courts have confirmed the attorney general’s authority to delegate the management of politically sensitive investigations to a special counsel.

MORE LEGAL BATTLES AHEAD FOR DONALD  TRUMP

Cannon’s ruling dismissed the charges against Trump and his co-defendants, Walt Nauta and Carlos De Oliveira.

All faced accusations of retaining classified documents at Trump’s Mar-a-Lago estate in Florida.

However, the legal battle is far from over.

Trump also faces sentencing in September for serious crimes related to money paid to porn star Stormy Daniels.
