Judge annuls ruling and allows Biden administration to end “Remain in Mexico”

A federal judge in Texas annulled his order to reinstate the «Remain in Mexico» protocols, allowing the Biden administration to finally end the policy, which forced asylum seekers to wait outside the United States for their applications to be processed, EFE reported on Monday night.

On Monday, Texas federal Judge Matthew Kacsmary overturned his ruling in response to a request by the US Justice Department. The petition was based on the decision issued last June by the Supreme Court, which ruled that the Biden administration can end the policy established in 2019 by his predecessor Donald Trump.

In February 2021, the Democratic administration eliminated the Migrant Protection Protocols (MPP), also known as «Remain in Mexico», established by Trump. However, in response to a lawsuit led by Texas, the courts forced the administration restore the policy last December, reported EFE.

The Supreme Court ruling sent the legal complaint back to the lower courts so that they take into consideration the memorandum issued last October by Homeland Security Secretary, Alejandro Mayorkas, according to the news agency.

Alejandro Mayorkas argued that there were flaws in the process and a lack of “humanitarian protections that people deserve under the law,” concurring with the reasons that immigration advocates had put forward against the “Remain in Mexico” program. He stated: «It has flaws of origin and imposes unjustifiable human costs.»

According to EFE, in a statement issued on Monday, the Department of Homeland Security (DHS) welcomed the judge’s decision and stated that «it is committed to ending the implementation of MPP in a quick and orderly manner.”

More than 60,000 asylum seekers, most of whom were stranded in camps on the Mexican border, were included in the first part of the program. About 5,800 immigrants have been processed through the second phase of MPP imposed since last December, according to recent figures. The majority of immigrants are from Nicaragua, Cuba, Colombia and Venezuela, according to EFE.

The AP news agency had reported earlier this month that there were approximately 70,000 migrants who were subject to that policy, from the time Trump began implementing it in January 2019 until Biden suspended it on his first day in office in January 2021, fulfilling a campaign promise. During the first months of the Biden presidency, many people were allowed to return to the United States to deal with their cases.
